Terms of Service

By accessing or using KitVault ("the Service"), operated at kitvault.studio, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all visitors, registered users, and subscribers.

KitVault provides subscription-based and credit-based access to digital audio content including drum kits, sample packs, MIDI files, Serum presets, and other producer resources. Access to content is governed by the plan you have purchased.

You must be at least 13 years old to use KitVault. If you are under 18, you confirm that you have your parent or guardian's permission. By using the Service you represent that all information you provide is accurate and that you have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at kitvaultdrumkits@gmail.com if you suspect unauthorised access. You may not create multiple accounts to circumvent restrictions, credit limits, or bans.

Subscriptions are billed on a recurring basis through Stripe. By subscribing you authorise us to charge your payment method on each renewal date until you cancel. Credit packs are one-time purchases and are non-refundable once purchased, except where required by law. We reserve the right to change pricing at any time with 30 days' notice for existing subscribers.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not provide prorated refunds for partial billing periods. Refunds may be granted at our sole discretion for technical failures that prevent access. Upon downloading content through a valid subscription or credit purchase, we grant you a non-exclusive, non-transferable, worldwide licence to use that content in your own original music productions, including commercial releases, sync placements, and beats for sale.

You may not:

• •Redistribute, resell, or share the original unmodified content files
• •Upload content to sample pack marketplaces or loop libraries
• •Claim ownership of the original content
• •Use content in AI training datasets or generative model training
• •Share your account or provide access to content to third parties

You agree not to:

• •Use the Service for any unlawful purpose or in violation of any applicable law
• •Attempt to gain unauthorised access to any part of the Service or its infrastructure
• •Reverse engineer, scrape, or systematically download content in bulk
• •Use automated tools, bots, or scripts to interact with the Service
• •Circumvent any technical measures designed to protect content or the Service
• •Engage in chargebacks without first contacting us to resolve the dispute
• •Harass, threaten, or abuse KitVault staff or other users

We reserve the right to suspend or permanently terminate your account, without notice or refund, if we determine at our sole discretion that you have:

• •Violated any provision of these Terms
• •Engaged in fraudulent, abusive, or illegal activity
• •Initiated unjustified chargebacks or payment disputes
• •Shared account access or content files with third parties
• •Created multiple accounts to circumvent restrictions
• •Attempted to exploit, hack, or disrupt the Service

Upon termination, your licence to use any downloaded content is revoked and you must cease all use of it. We may also pursue any available legal remedies.

Credits are virtual currency within KitVault. They have no cash value, are non-transferable, and expire if your account is terminated. Referral bonuses, milestone rewards, and loyalty credits are granted at our discretion and may be modified or withdrawn at any time.

All content, trademarks, logos, and software on KitVault are the property of KitVault or its licensors. Nothing in these Terms transfers any ownership to you. You may not use our branding or trademarks without prior written permission.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by applicable law, KitVault and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

You agree to indemnify and hold harmless KitVault and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force.

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the site or emailing you. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
